Insurance Considerations, Compensation Insurance

i was contacted by state farm the next morning and explained my version of events and agreed to send them all photos of the accident ( i took phots of the vehicles in there final rest position full 360 deg view) well after many emails as of the dec 16 2010 state farm  insurance has still been trying to get in contact with their insured and get her version of the accident. today at 1131 am on 17 dec 2010 i get a call from state farm saying that they have concluded their investigation and they are finding it a 50/50 accident.

i called back and talked to them and they explained that based on their review of the photos from the scene neither of us attempted to avoid the accident and we both did not look to see if it was safe and they would only pay half of may damages and my insurance would pay half of their insured's damages.

I told them very firmly  insurance that i do not agree with this decision and i was then transferred over to a claims adjuster. after being on hold so she could review the file she got back on the phone and was very rude and then said i did not try to avoid the accident. when i explained to her to look at my wheels in the photos, and the final position of my vehicle  insurance and the debris field you can plainly see the direct of impact and it shows i tried to avoid her once i saw her.

lil does she know im a police officer and do traffic accidents so i know what im talking about. she became hostile to me and after a few heated words i was hung up on in a very rude way. now my questions are this how can ya determine a 50/50 fault when the evidence is right in front of you, and if i had not attempted to avoid her explain how there was no body damage to my vehicle insurance other that what is there damage to both vehicles would have been far worse, my main question is why is your insured not returning calls to not only their claims agent but to mine as well. like a good neighbor my XXX that slogan has to go i have good neighbors and when we break each others stuff which we have we take care of it and don't avoid it.
